Hierdie beleid voldoen aan die Wet op die Beskerming van Persoonlike Inligting (POPIA, Wet 4 van 2013). Beide Afrikaans- en Engelse weergawes verskyn hieronder; die Afrikaanse weergawe geld in geval van enige verskil.

1. Wie ons is

gids.co.za word bedryf deur AquaSoft ("ons", "ons s'n"), 'n SA-besigheid gebaseer in Stellenbosch, Wes-Kaap. In POPIA-terme is AquaSoft die verantwoordelike party wat besluit hoekom en hoe jou persoonlike inligting verwerk word.

Hierdie beleid verduidelik watter persoonlike inligting ons versamel wanneer jy gids.co.za gebruik, hoekom ons dit versamel, met wie ons dit deel, en watter regte jy onder POPIA het.

2. Watter persoonlike inligting ons versamel

Ons versamel slegs die persoonlike inligting wat ons nodig het om die platform te bedryf en jou toegang tot betaalde inhoud te gee.

3. Hoekom ons jou inligting verwerk

Ons gebruik jou persoonlike inligting vir die volgende doelwitte:

• Om jou rekening te skep en bestuur — naam, e-pos en wagwoord is nodig vir registrasie en aanmelding.
• Om betaalde toegang te verleen — betalings-inligting koppel jou rekening aan die regte produk.
• Om die platform te bedryf — tegniese data laat ons sien wanneer iets stukkend is en help ons om fouten reg te stel.
• Om met jou te kommunikeer — wanneer jy 'n vraag het, of vir noodsaaklike kennisgewings oor jou rekening.
• Om die platform te verbeter — algemene gebruiks-patrone help ons besluit watter inhoud om uit te brei.
• Om wettige verpligtinge na te kom — bv. belasting-rekords moet 5 jaar gehou word.

Ons sal jou inligting nie vir advertensies, bemarking aan derde partye, of doelwitte buite hierdie lys gebruik nie.

4. Wettige basis vir verwerking

POPIA artikel 11 vereis 'n geldige regverdiging vir die verwerking van persoonlike inligting. Ons verwerk jou inligting op die volgende gronde:

• Kontraktuele noodsaaklikheid. Om die diens te lewer waarvoor jy ingeskryf of betaal het.
• Toestemming. Vir items buite die kontrak — bv. opsionele kommunikasie. Jy kan toestemming enige tyd intrek.
• Wettige verpligting. Bv. om belasting-rekords te hou soos die Inkomstebelastingwet vereis.
• Regmatige belang. Vir basiese tegniese logging en sekuriteits-monitering. Hierdie belang word nie deur jou regte en vryhede oorskry nie.

5. Kinders se persoonlike inligting

Wat hierdie prakties beteken:

• 'n Ouer/voog moet 'n rekening namens 'n minderjarige leerder skep, of toestemming gee vir die kind om dit self te doen.
• Betalings moet deur 'n volwassene gedoen word.
• Ouers/voogde het die reg om enige tyd te sien watter inligting ons oor hul kind hou.
• Ouers/voogde mag versoek dat 'n kind se rekening (en alle data) uitgevee word — sien afdeling 9 hieronder.
• Ons sal kommunikasie wat regstreeks aan kinders gerig is met die ouer/voog se e-posadres koördineer indien moontlik.

Indien jy 'n ouer of voog is en jy is bekommerd oor wat ons oor jou kind hou, kontak hallo@gids.co.za en ons sal binne 7 werksdae reageer.

6. Met wie ons jou inligting deel

Ons verkoop nooit jou persoonlike inligting nie. Ons deel dit slegs met derde partye wat noodsaaklik is om die platform te laat werk:

6.1 PayFast (betalings-verwerker)

Wanneer jy 'n aankoop maak, gee ons jou e-pos en transaksie-bedrag aan PayFast (Pty) Ltd, 'n geregistreerde SA-betalingsverwerker. PayFast versamel direk jou kaart-besonderhede — ons sien dit nooit.

PayFast se eie privaatheidsbeleid is beskikbaar by payfast.io/privacy-policy.

6.2 Web-bediener (hosting)

Jou data word gestoor op bedienerinfrastruktuur in Suid-Afrika. Ons hosting-verskaffer hanteer slegs die tegniese infrastruktuur en mag nie jou data vir hul eie doeleindes gebruik nie.

6.3 Wettige versoeke

Ons sal jou inligting deel met owerhede slegs indien wettig verplig (bv. 'n hofbevel, polisie-ondersoek, of belasting-revisie).

6.4 Geen oorgrense oordrag nie

Jou persoonlike inligting word in Suid-Afrika gestoor en verwerk. Ons stuur dit nie na ander lande nie.

Indien jy versoek dat jou data uitgevee word, sal ons dit dadelik doen — behalwe waar wettige verpligtinge ons verplig om dit te hou (bv. belasting-rekords).

8. Hoe ons jou inligting beskerm

POPIA artikel 19 vereis dat ons toepaslike tegniese en organisatoriese maatreëls neem om jou data te beskerm. Wat ons doen:

• Enkripsie tydens oordrag. Die hele webwerf gebruik HTTPS/TLS.
• Wagwoord-hashing. Wagwoorde word nie in skoonteks gestoor nie; hulle word met 'n veilige hashing-algoritme verwerk.
• Toegangsbeperking. Slegs AquaSoft se eienaar/operateur het toegang tot persoonlike data, en slegs vir wettige doeleindes.
• Sekuriteits-opdaterings. Bediener-sagteware en platform-kode word gereeld opgedateer.
• Veiligheidsmonitering. Verdagte aktiwiteit word in bediener-logs opgespoor.

Geen stelsel is 100% veilig nie. Indien daar 'n insident is wat jou persoonlike inligting in gevaar stel, sal ons jou kennis gee soos POPIA artikel 22 vereis.

9. Jou regte onder POPIA

POPIA gee jou (en die ouer/voog van 'n minderjarige) die volgende regte:

• Reg op kennis — om te weet welke persoonlike inligting ons oor jou hou.
• Reg op toegang — om 'n kopie van daardie inligting te kry.
• Reg op korreksie — om foutiewe of onvolledige inligting te laat regstel.
• Reg op uitwissing — om jou data te laat uitvee waar daar geen wettige rede is om dit te hou nie.
• Reg op beperking — om verwerking te stop terwyl 'n besware ondersoek word.
• Reg op besware — om besware aan te teken teen verwerking gegrond op regmatige belang of direkte bemarking.
• Reg op klagte — om 'n klagte by die Inligtingsreguleerder in te dien (sien afdeling 12).

Hoe om jou regte uit te oefen

Stuur 'n e-pos aan hallo@gids.co.za met:

• Jou naam en die e-pos van jou rekening
• Watter reg jy uitoefen (toegang, korreksie, ens.)
• Indien moontlik, spesifieke besonderhede

Ons sal binne 30 dae reageer. Hierdie diens is gratis. Vir POPIA-versoeke wat duidelik onredelik is (bv. herhaalde versoeke vir dieselfde inligting binne kort tyd), mag ons 'n redelike fooi vra.

10. Koekies en opsporing

'n Koekie is 'n klein lêertjie wat 'n webwerf op jou rekenaar/foon stoor om jou tussen besoeke te onthou.

Ons gebruik die volgende koekies:

Ons gebruik nie derde-party opsporings-koekies vir advertensies of analise nie (geen Google Analytics, Facebook Pixel, ens.).

Jy kan koekies in jou blaaier-instellings afsit, maar sommige funksies (soos aanmelding) sal nie sonder hulle werk nie.

11. Inligtingsbeampte

POPIA artikel 55 vereis dat elke verantwoordelike party 'n Inligtingsbeampte aanwys. Ons s'n is:

Die Inligtingsbeampte is verantwoordelik vir POPIA-nakoming, antwoord op datasubjekte se versoeke, en koördineer met die Inligtingsreguleerder.

12. Klagtes

Indien jy ongelukkig is met hoe ons jou persoonlike inligting hanteer, doen die volgende:

13. Veranderinge aan hierdie beleid

Ons mag hierdie beleid van tyd tot tyd opdateer. Wanneer dit gebeur:

• Die "Laas opgedateer"-datum bo aan die bladsy verander.
• Vir materiële veranderinge (bv. nuwe derde party, nuwe data-tipe wat versamel word) stuur ons 'n e-pos aan alle aktiewe gebruikers ten minste 30 dae voor die verandering effektief raak.
• Vir klein veranderinge (bv. spelfoutregstelling, kontak-besonderhede opdateer) opdateer ons bloot die bladsy.

1. Who we are

gids.co.za is operated by AquaSoft, a South African business based in Stellenbosch, Western Cape. Under POPIA, AquaSoft is the responsible party deciding why and how your personal information is processed.

2. What personal information we collect

What we do NOT collect: credit/debit card numbers (these go directly to PayFast), ID/passport numbers, bank details, health information, GPS/location, or social media activity.

3. Why we process your information

• Account management — name, email and password are needed for registration and login.
• Granting paid access — payment info links your account to the right product.
• Running the platform — technical data helps us spot and fix problems.
• Communicating with you — when you have a question, or for essential account notices.
• Improving the platform — aggregate usage patterns help us decide which content to expand.
• Meeting legal obligations — e.g. tax records must be kept for 5 years.

We do not use your information for advertising, marketing to third parties, or any purposes outside this list.

4. Lawful basis for processing

POPIA section 11 requires a valid justification for processing personal information. Ours are:

• Contractual necessity — to deliver the service you signed up or paid for.
• Consent — for items outside the contract, e.g. optional communications. You can withdraw consent any time.
• Legal obligation — e.g. tax records as required by the Income Tax Act.
• Legitimate interest — for basic technical logging and security monitoring. This interest is not overridden by your rights and freedoms.

5. Children's personal information

Our audience is primarily children. Grade 7 learners are typically 12-13 years old.

POPIA section 35 requires that the personal information of a child (under 18) may only be processed with the consent of a competent person — usually a parent or guardian.

In practice this means:

• A parent/guardian must create an account on behalf of a minor learner, or give consent for the child to do so.
• Payments must be made by an adult.
• Parents/guardians have the right to see what information we hold about their child at any time.
• Parents/guardians may request that a child's account (and all data) be deleted — see section 9.

6. Who we share your information with

We never sell your personal information. We only share it with third parties essential to running the platform:

6.1 PayFast (payment processor)

When you make a purchase, we share your email and transaction amount with PayFast (Pty) Ltd, a registered SA payment processor. PayFast directly collects your card details — we never see them. Their privacy policy: payfast.io/privacy-policy.

6.2 Web host

Your data is stored on server infrastructure in South Africa. Our hosting provider handles only the technical infrastructure and may not use your data for their own purposes.

6.3 Legal requests

We will share your information with authorities only if legally required (e.g. court order, police investigation, tax audit).

6.4 No cross-border transfer

Your personal information is stored and processed in South Africa. We do not send it abroad.

8. How we protect your information

POPIA section 19 requires appropriate technical and organisational measures. What we do:

• Encryption in transit — the entire site uses HTTPS/TLS.
• Password hashing — passwords are never stored in plaintext; they're processed with a secure hashing algorithm.
• Access restriction — only AquaSoft's owner/operator has access to personal data, and only for legitimate purposes.
• Security updates — server software and platform code are regularly updated.
• Security monitoring — suspicious activity is logged.

No system is 100% secure. If there is an incident affecting your personal information, we will notify you as POPIA section 22 requires.

9. Your rights under POPIA

POPIA gives you (and the parent/guardian of a minor) the following rights:

• Right to know — what personal information we hold about you.
• Right of access — to a copy of that information.
• Right of correction — to fix inaccurate or incomplete information.
• Right of deletion — to have your data deleted where there's no lawful reason to keep it.
• Right to restriction — to stop processing while an objection is investigated.
• Right to object — to processing based on legitimate interest or direct marketing.
• Right to lodge a complaint — with the Information Regulator (see section 12).

How to exercise your rights

Email hallo@gids.co.za with your name, account email, which right you are exercising, and any specific details. We will respond within 30 days. This service is free.

10. Cookies and tracking

A cookie is a small file a website stores on your device to remember you between visits.

We do not use third-party tracking cookies for ads or analytics (no Google Analytics, Facebook Pixel, etc.). You can disable cookies in your browser settings, but some features (like login) won't work without them.

13. Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top changes. For material changes (e.g. a new third party, new data type collected), we email all active users at least 30 days before the change takes effect. For minor changes (e.g. typo fixes, contact updates), we simply update the page.
